OVERVIEW

Welcome to CrystalsFirst Shop! The terms "we", "us" and "our" refer to CrystalsFirst Shop, owned by CrystalsFirst GmbH. CrystalsFirst operates this shop and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with an individual shopping experience (the "Services"). CrystalsFirst Shop is powered by Shopify, which enables us to provide the Services to you.

By visiting or using our Services, you agree to these General Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree, you may not access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are of legal age in your place of residence. You are responsible for the security of your account credentials. You represent that all information provided during registration or purchase (email, billing, and payment info) is accurate and complete.

SECTION 2 – OUR PRODUCTS AND QUALITY

We endeavor to display product colors and images accurately. However, we cannot guarantee that your monitor's display of any color will be accurate. All product descriptions are subject to change at any time without notice. We reserve the right to limit quantities or discontinue products at any time.

SECTION 3 – ORDERS AND CONTRACT CONCLUSION

Your order constitutes a binding offer to purchase. The contract is only concluded when we confirm the order or ship the goods. Acceptance is subject to successful payment processing. Right of Withdrawal: Please note that according to Section 312g (2) No. 2 BGB, the right of withdrawal is excluded for goods that can spoil quickly or whose expiration date would be quickly exceeded (e.g., scientific samples requiring a continuous cold chain). Once the packaging is opened, these materials cannot be returned.

SECTION 4 – PRICING AND BILLING

Prices are subject to change without notice. The price at the time of the order applies. Unless stated otherwise, prices do not include VAT (if applicable), shipping, or customs duties. You agree to provide current and accurate payment information for all transactions.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates and not guaranteed.

For Consumers (B2C): The risk of accidental loss or damage passes to you upon delivery of the goods to you or a designated recipient.
For Business Customers (B2B): The risk of loss and title pass to you as soon as we have handed over the products to the shipping carrier (§ 447 BGB).

SECTION 6 – INTELLECTUAL PROPERTY

All content (text, graphics, logos, images) is the property of CrystalsFirst GmbH or its licensors and is protected by copyright and trademark laws. Use is permitted for personal, non-commercial purposes only. Any reproduction or distribution requires our prior written consent.

SECTION 7 & 8 – THIRD-PARTY TOOLS AND LINKS

We may provide access to third-party tools or links (e.g., Shopify features). These are provided "as is" without any warranties. We are not liable for the content or functionality of third-party websites.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

CrystalsFirst Shop is hosted on Shopify. However, your contract is exclusively with CrystalsFirst GmbH. Shopify is not responsible for the products or transactions and is released from any liability regarding the purchase agreement.

SECTION 10 – PRIVACY

Your submission of personal information is governed by our Privacy Policy and, where applicable, Shopify’s Privacy Policy.

SECTION 11 – FEEDBACK AND REVIEWS

If you send us suggestions or reviews, you grant us a worldwide, non-exclusive license to use and publish that content. We reserve the right to remove content that is unlawful or violates these Terms.

SECTION 12 – PROHIBITED USES

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon intellectual property; (d) to upload viruses or malicious code; (e) to collect personal data of others. Violation may lead to immediate termination of your access.

SECTION 13 – WARRANTY AND LIABILITY

The statutory warranty rights of the Federal Republic of Germany apply. Limitation of Liability: CrystalsFirst GmbH is liable without limitation for:

Damages from injury to life, body, or health.
Intentional or grossly negligent breach of duty.
Mandatory liability under the Product Liability Act (Produkthaftungsgesetz). For slight negligence, we are only liable in case of a breach of a material contractual obligation (cardinal obligation), limited to the foreseeable, typically occurring damage.

SECTION 14 – INDEMNIFICATION

You agree to indemnify CrystalsFirst GmbH from any third-party claims arising from your culpable breach of these Terms or the law.

SECTION 15 – SEVERABILITY

If any provision of these Terms is determined to be unlawful or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

SECTION 16 – GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For Consumers: Mandatory consumer protection laws of your country of residence remain unaffected.
For Business Customers: The exclusive place of jurisdiction is Marburg, Germany
